Patent as Evidence

Patent as evidence is the wiki's standing rule for reading patent documents: a patent, a patent application or a patent drawing is a claim document, not a demonstration that the described device, material or method works as stated. It recurs across the source dossier cluster, where many pages consist of a patent number, an image, and little else.

What a patent does and does not establish

A patent establishes that an application was filed, examined to the standard of the granting office, and issued (or, for a published application, that the filing was published). It may describe an apparatus, a composition or a method. It does not establish:

• that a working device was built;
• that the device performs as described;
• that any measurement was made;
• that the result is reproducible;
• that an independent party reproduced the result.

Patent offices do not require proof of operability in the sense of independent experimental validation, and they do not adjudicate whether a claimed effect is physically possible.

How this applies here
